Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and EarnSprout ("we," "us," or "our"). By downloading the EarnSprout app or using any part of our Service at https://earnsprouts.com, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an EarnSprout account. By using the Service, you represent that you have the legal capacity to enter into binding contracts. Accounts are for personal, family, non-commercial use only.

Children under 13 may use the app only through a child profile created and managed by a parent or legal guardian who has accepted these Terms. Children's profiles do not require email addresses or independent accounts.

2. Your Account

You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Ensuring that any co-parents or grandparents you invite comply with these Terms.
• Notifying us immediately at support@earnsprouts.com if you suspect unauthorized access.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 2 years.

3. Subscriptions & Billing

Free Plan

The Free plan is available to all registered users at no charge and includes limited features as described on our Pricing page.

Paid Plans

Premium and Premium Plus plans are billed monthly or annually via Stripe. By subscribing you authorize us to charge the payment method on file at the start of each billing period until you cancel.

Free Trial

New subscribers receive a 7-day free trial. No payment is taken during the trial. After 7 days, your plan renews automatically at the applicable subscription price. You may cancel before the trial ends to avoid any charge.

Price Changes

We may change subscription prices with at least 30 days' written notice. Continued use after the notice period constitutes acceptance of the new price.

Cancellation

You may cancel your subscription at any time from the Billing settings page or the mobile app Settings screen. You retain access to paid features until the end of your current billing period. Cancellation does not delete your account or data.

4. Refund Policy

We offer a 7-day money-back guarantee on the first payment for any new paid subscription. If you are not satisfied, contact us within 7 days of your first charge at support@earnsprouts.com or use the "Request Refund" button in the Billing settings, and we will issue a full refund — no questions asked.

Refunds are not available for:

• Charges more than 7 days old (except where required by law).
• Renewals after the initial subscription period.
• Partial billing periods after cancellation.

Refunds are processed to the original payment method within 5–10 business days. If you are located in the EU or UK, you may have additional statutory rights including a 14-day cooling-off period for digital services not yet fully performed.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to access another user's account.
• Reverse-engineer, decompile, or extract source code from the app.
• Upload content that is illegal, harmful, abusive, or violates any third-party rights.
• Use automated bots or scrapers on the Service.
• Resell or sublicense access to the Service.
• Interfere with or disrupt the integrity or performance of the Service.

6. Content You Upload

You retain ownership of content you upload (photos, chore descriptions, prayer entries). By uploading, you grant EarnSprout a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely to provide the Service to your family.

You are responsible for ensuring that uploaded photos and content do not violate any laws or third-party rights. We do not use your family photos for any purpose other than displaying them within your account.

7. Intellectual Property

EarnSprout and its logos, design, features, and content are owned by us and are protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or copyrights beyond using the Service as intended. You may not copy or reproduce any part of the Service without written permission.

8. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), Cloudinary (media storage), and Expo (push notifications). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these providers.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNSPROUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR (B) $50 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless EarnSprout and its officers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be attempted to be resolved informally. If informal resolution fails within 30 days, disputes shall be resolved through binding arbitration under the JAMS Streamlined Arbitration Rules, with proceedings in English.

Notwithstanding the above, EarnSprout may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use after the effective date constitutes your acceptance of the revised Terms.

14. Termination

You may delete your account at any time from the Settings screen. We may suspend or terminate your account for violations of these Terms, abuse, or non-payment, with notice where required by law. Sections 7, 9, 10, 11, and 12 survive termination.
